Description of the incident: Right, so I was the CMO, and from what I could see command was being incompetent, the ship was in a bad way as the SM was gone, and we also lost most of the atmos too. We had 8 power alarms and 3 atmos alarms, so I wanted to get the marines out of harms way. I declared command mentally unfit for duty, and then proceeded to make sure the pods were fueled and ready to go so that we could escape. The CO then orders my arrest, with no reason stated, and then personally starts searching the ship for me. He finds me in the escape corridor, and asks me to stop, I go around the corner. He tells me to stop again, so I do and start to talk to him, stating that I am doing nothing wrong and acting in the interests of the remaining people who were alive. He then smacks me with his handgun, and begins to unload on me with ZERO RP, I was not moving and I was not even armed. I even tried to ask him why he was shooting me, before giving up and taking an M44 out of my pack (which I had been given earlier on in the round due to xenos being present on the ship). The MP then helps to kill me, and then I am dead.

How you would punish the accused: Needs some kind of punishment, but Ill leave you guys to decide what.

After looking into the situation I have come to the conclusion that like free came to in-game there is not enough evidence for either side to be punished.

The thing is, Russell, as the CMO, did commit mutiny by declaring all of command mentally unfit for duty without A, getting permission from CC to do so and B, adequate te reasoning to do so. russells reasoning for declaring command mentally unfit is that the ship was in disarray with power alarms and the SM being gone (im also going to assume the failure of the mission had something to do with it) and command being incompetent. As a civilian member of the ship you do not have authority to over-ride command (what you attempted to do with the evac order and then promptly declare them unfit for duty without CC permission). The only situation in which you can declare command unfit for duty as CMO is if they are actively being really stupid and you have crew support or if they are griefing (which they were not) Moreover at the time the command staff was trying to organize a counter-attack (this was only about six minutes before the CO afked and russel declared them unfit)

Your actions at declaring them unfit for duty caused a fair amount of marines to use this as a carte blanc to ignore and be assholes to most of command going as far as to throw the XO out of a pod

And to top it off the CO was AFK the entire time only coming back to find out you declared him and his staff unfit for duty and caused marines to start mutinying against them.

However at the same time that is not enough for a punishment and the command staff did kill you in the end for it.

Now the thing with the reason for this report (the killing) is that the CO was justified to execute you for your borderline attempted mutiny. But he did not execute you, he shot you without proper escalation of force claiming adamantly in the admin PMs that you pulled out your gun first. The thing here is that without credible eye witness (no one has come forward) there is absolutely no way to know who pulled out the gun first, we know he hit you first and that you didn't resist before the MP started attacking but again he did have the right to execute you.

But another thing is that the order in which is happened is kinda weird. The CO confronted you and you told him you did nothing wrong at which point he hit you
and started gasping for 10 seconds (im assuming you ran here) before the MP started shooting you.

With that im going to come to the conclusion that the CO attempted to arrest you, hit you with the gun by accident, you ran and the CO started gasping so the Mp promptly shot you assuming you attacked the CO, CO saw MP shooting you and joined in.

All in all:

The CO did use improper escalation of force to kill you but at the same time he had the right to execute you for declaring command unfit without CC authorization and causing the marines to borderline mutiny against command.

You as the CMO declared command unfit without CC authorization and caused marines to borderline mutiny giving the CO reason to execute you.

So my verdict is no punishment on either side (not enough evidence on who pulled out a gun first) but a note will be added to both C-keys. One for improper execution and the other for declareing command unfit without CC authorization and causeing a borderline mutiny.
